General Terms and Conditions Repender B.V.

1. Company information

In these General Terms and Conditions, the following terms shall have the following meanings:

Platform: The online platform managed by Repender B.V. on which consumers can compare repairers and schedule repairs.
Repairer: Company that has created an account on the platform and offers services to consumers.
Consumer: Private individual who schedules a repair via the platform.
User: Both the Repairer and the Consumer who uses the platform.
Service: The services offered via the platform, including the CRM system for repairers and the repair comparison service for consumers.

These General Terms and Conditions apply to all agreements and legal relationships between Repender B.V. and the users of the platform.
Deviations from these General Terms and Conditions are only binding if agreed in writing.

Repender B.V. offers consumers the opportunity to compare repairers and schedule repairs via the platform.
Repairers can use a CRM system for a monthly or annual fee and pay a commission of 5% on every repair received via the platform.

Only companies (Repairers) can create an account on the platform. Creating an account is required to use the CRM system and to offer services via the platform.
Consumers do not need to create an account to schedule a repair.

Users are responsible for providing correct and truthful information.
Repairers are obliged to provide the agreed services to consumers in a timely and proper manner.
Users are not permitted to post illegal, offensive or otherwise inappropriate content on the platform. Repender B.V. reserves the right to remove such content without prior notice.

Subscriptions for the CRM system: Repairers who want to use the CRM system of Repender B.V. must take out a subscription. This subscription can be concluded monthly or annually.
- The monthly subscription is automatically renewed at the end of the paid period, unless the user cancels the subscription in time.
- The annual subscription is also automatically renewed for a new annual period, unless it is canceled in time.
- Cancellations of subscriptions can be submitted at any time, but amounts already paid will not be refunded. The subscription remains active until the end of the already paid term.
Payment Processing: Payments for subscriptions and commissions are processed via Mollie, and can be paid by credit card, SEPA, and PayPal.
Commissions: For every repair scheduled via the platform, a commission of 5% of the turnover is automatically charged to the repairer.

Repender B.V. respects the privacy of all users and processes personal data in accordance with the GDPR/AVG regulations.
A privacy policy describing how data is collected, processed and protected will be made available on the platform.

Repender B.V. is not liable for damage or losses caused by the use of the platform, unless there is intent or gross negligence on the part of Repender B.V.
Repairers are themselves responsible for the quality and performance of the services they offer via the platform.
Consumers must resolve any complaints directly with the repairer in question. Repender B.V. does not provide any guarantees for the quality of the services provided by repairers.

Disputes between users must first be resolved amicably.
If a dispute cannot be resolved amicably, it can be submitted to a competent court in the district where Repender B.V. is established.

Repender B.V. reserves the right to terminate accounts or deny access to the platform if users act in violation of these Terms and Conditions.
Repairers can terminate their account at any time, in which case they are obliged to pay any outstanding payments.

Repender B.V. reserves the right to change these Terms and Conditions at any time. Users will be notified of changes via the platform.
If a user does not agree with the changes, he has the right to terminate his account.
